I am suing Mr. Moak for legal mal practice of my chapter 7 case. I had to fire him because I could no longer trust him after giving incorrect legal advice. The court appointed trustee claimed my house appreciated market value 5 months after Mr. Moak advised me in an email that appreciated value after petition date is not a concern for trustee to sell my home. He didn't advise me of an option to protect my home from trustee claims when my home value had already exceeded the allowable exemption. I hired another attorney to take over and settle with the trustee to avoid having my home being sold by the trustee. Mr. Moak does not carry any mal practice insurance liability. I did file a bar complaint with the AZ bar for his billing practice and behavior. I learned from the AZ bar that Mr. Moak 's legal past does include suspension from the Arizona bar for past conduct.
